Definitions
Definitions below are quoted/paraphrased from the 2025 Amended and Restated Declaration Article I unless noted.
- Association — SummitRidge Townhomes Homeowners Association, an Oregon nonprofit corporation, its successors and assigns (Source: Declaration Article I.A).
- Board — Board of Directors of the Association (Source: Declaration Article I.B; Bylaws Article I § 1.1).
- Building Site — the portion of a Lot upon which a Living Unit may be constructed (Source: Declaration Article I.C).
- Building Structure — a structure of one or more contiguous Living Units on Lots, including attached garages (Source: Declaration Article I.D).
- City — City of Lake Oswego, Oregon (Source: Declaration Article I.E).
- Common Properties / Common Areas — land for the common use, enjoyment and/or benefit of all Members, including the Private Open Space Tracts labeled Tract A and Tract B (Source: Declaration Article I.F). The Rules and Regulations Handbook elaborates that Common Areas include private streets, parking areas, retaining walls, curbs, gutters, utilities thereon, and landscaped areas (Source: Rules and Regulations, Common Elements).
- Declarant — SummitRidge Townhomes Homeowners Association in the 2025 restated document; originally SummitRidge Townhomes, LLC (Source: 2025 Declaration Preamble; 1999 CC&Rs Preamble).
- Improvement — every structure or improvement of any kind, including fences, walls, driveways, storage shelters, patios, decks (Source: Declaration Article I.G).
- Living Unit — any structure designed and intended for use, occupancy and ownership as a residence by a single household (Source: 2025 Declaration Article I.H — the 1999 CC&Rs used "single family").
- Lot — a numbered plot on the Plat, Lot 1 through Lot 21 (Source: Declaration Article I.I).
- Master Restrictions — restrictive covenants recorded August 5, 1968, Book 633, Page 882, Multnomah County (i.e., Mountain Park) (Source: Declaration Article I.K).
- Member — every person or entity who holds membership in the Association (Source: Declaration Article I.J; Article II § 1).
- Outdoor Living Area — the portion of a Lot adjacent to a Building Structure that is screened, enclosed, or set off for private outdoor living/landscaping (Source: Declaration Article I.L).
- Owner — record owner of title to any Lot (fee simple owner or contract vendee); excludes mortgagees / land-sale-contract vendors holding only a security interest (Source: Declaration Article I.M).
- Plat — the recorded subdivision plat for SummitRidge Townhomes, Multnomah County Book 1245, pages 34–35 (Source: Declaration Recitals; Article I.N).
- Private Open Space Tracts — Tracts A and B as designated on the Plat (Source: Declaration Article I.O).
- Property — the SummitRidge Townhomes subdivision (Source: Declaration Recitals).
- Set back — the minimum distance between a structure and a Lot line as shown on the Plat (Source: Declaration Article I.Q).
- Street — any public right-of-way for vehicular traffic shown on the Plat (Source: Declaration Article I.R).
- Street Frontage — portion of a Lot/Building Site bordering a Street (Source: Declaration Article I.S).
- Turnover Date — the date on which Class B membership converts to Class A (Source: Bylaws Article I § 1.7). Class B has now ended — see Membership and Voting.
- Architectural Committee ("AC") / Architectural Review Committee ("ARC") — committee that approves exterior improvements; minimum of three members after Declarant delegates authority (Source: Declaration Article VII § 1; Bylaws Article X).
