Noise

General duty of care

Owners and occupants must exercise extreme care not to make noises that may disturb other Owners — including use of musical instruments, radios, televisions, and amplifiers (Source: Handbook — Noise).

The Declaration also prohibits any "noxious or offensive activity" or anything that becomes an annoyance or nuisance to the neighborhood (Source: Declaration Article V § 1.D).

Quiet Time

Quiet Time will be observed between the hours of 10:00 PM and 8:00 AM. During this time:

City of Lake Oswego — Unnecessary Noise Code (§ 34.10.537)

The Handbook quotes the following as examples of violations (Source: Handbook — Noise):

"Excessive noise" means noise that is plainly audible within any dwelling unit which is not the source of the sound. For the complete listing, refer to the City of Lake Oswego Codes § 34.10.537.

Note: The Handbook's HOA "Quiet Time" of 10 PM–8 AM is one hour longer in the morning than the City Code's 10 PM–7 AM. The stricter standard governs at SummitRidge (see Declaration Article XI § 3 — municipal ordinances govern where more restrictive, but here the HOA rule is more restrictive in the morning hour).

Enforcement Procedures (Noise)

  1. The offended party should first talk with the home owner/tenant and request that the noise be stopped.
  2. Should the noise persist, contact the City of Lake Oswego Code Services and file a noise complaint.
  3. If it is an emergency, call 911.

The Handbook does not specify HOA-imposed fines for noise — enforcement primarily flows through the City. The general Declaration enforcement remedies (suspension of rights, fines, suit) remain available — see Enforcement and Fines.
