Trash and Recycling

Container and storage rules

• All garbage and other waste must be kept in appropriate sanitary containers for proper disposal (Source: Declaration Article V § 1.G; Article VII § 2.D; Handbook — Rubbish and Trash).
• Trash and recycling bins must be kept in the garage or out of public view, except for the day of collection (Source: Handbook — Rubbish and Trash).
• All items for trash and recycling are to be put out no sooner than the evening prior to collection (Source: Handbook — Rubbish and Trash).

Prohibitions

• No Lot or part of the Common Area shall be used as a dumping ground for trash or rubbish of any kind (Source: Declaration Article V § 1.G; Article VII § 2.D).
• All incinerators or other equipment for storage/disposal of waste must be kept in a clean and sanitary condition and comply with all local, state, and federal requirements (Source: Declaration Article V § 1.G).

Decks may not be used as storage

Decks may not be used as storage areas — including garbage/recycling bins, bicycles, tarps, etc. (Source: Handbook — Decks/Patios). See also Exterior Modifications.

Enforcement Procedures (Trash)

• First Offense: Owner receives a written warning of violation.

  If conditions under CC&Rs Article VII § 2(D) exist for a period longer than 10 days after the written notice of violation, the offense is considered a second offense.

• Second / Consecutive Offense: Owner receives a written notice of violation and a fine of $10.00 per day until remedied.

The Declaration likewise states: if a default under the Rubbish and Trash section exists longer than 10 days after written notice is mailed, the Association has all rights and remedies under the Declaration or at law or in equity (Source: Declaration Article VII § 2.D).
