Governing Documents
The HOA is governed by a layered set of recorded and adopted documents. The list below is in order of legal precedence (top binds bottom).
Hierarchy
- Applicable Oregon law — chiefly the Oregon Planned Community Act (ORS 94.550–94.783) and the Oregon Nonprofit Corporation Act. State law controls where it conflicts with internal documents (Source: Bylaws Article XXI; Declaration Article XI § 3).
- Master Restrictions (Mountain Park) — recorded August 5, 1968, in Book 633, Page 882, Multnomah County. Property is subject to these as amended from time to time (Source: Declaration Article I.K; Article VI § 1.D).
- City of Lake Oswego ordinances — control where more restrictive than the Declaration (Source: Declaration Article XI § 3).
- Amended and Restated Declaration of CC&Rs — recorded 06/20/2025 (No. 2025-038414) and re-recorded 07/07/2025 (No. 2025-042182) to add Exhibit A. Signed 06/17/2025 by William R. Marcucci (Chairperson) and Gary White (Secretary). This supersedes the 1999 Original Declaration and prior amendments.
- Bylaws — adopted May 22, 2002, certified by Pamela McKenna, Secretary (Source: Bylaws Certification).
- Board Resolutions — e.g., Maintenance Responsibility (2016-11-01), Collection (2017-10-20), Special Repair Assessment (2018-05-23).
- Rules and Regulations / Community Handbook (v1.2) — adopted by the Board; binding on Owners and tenants. A rule that conflicts with the Bylaws or Declaration is null and void (Source: Bylaws Article XIV).

Note on "Second Amendments": Two separate amendments are each titled "Second Amendment to Declaration" in the public record. This wiki disambiguates them as 2A (Collection) — recorded first on 09/25/2017 — and 2B (Rental Restrictions) — recorded 11/06/2017. The labels "2A/2B" appear only in this wiki for clarity; the recorded documents themselves both bear the title "Second Amendment." Both are independently recorded and effective. The rental restrictions amendment (2B) recites only the 1999 Declaration and 2016 First Amendment as predecessors, suggesting the two were drafted in parallel.
